    Hi Code Enforcement. Surprise!!! It's yet another problem with this property again...

    The lot is overgrown, with various weeds, vines, etc. Seeing as how we're having a bumper crop of poison ivy this year, this is especially urgent. Many neighbors would hate to have poison ivy and other invasive weeds spread from this abandoned, blighted property, into their nice, landscaped lawns.

    According to the Virginia Uniform Statewide Building Code, this property should be considered abandoned, and the permit to build should be revoked. USBC, Part I, Section 110.6: Abandonment of work, clearly states that:

    “A building official shall be permitted to revoke a permit if work on the site authorized by the permit is not commenced within six months after issuance of the permit, or if the authorized work on the site is suspended or abandoned for a period of six months after the permit is issued”…” It shall be the responsibility of the permit applicant to prove to the building official that authorized work includes substantive progress, characterized by approved inspections as specified in Section 113.3 of at least one inspection within a period of six months or other evidence that would indicate substantial work has been performed.”

    The building permit for this property was issued in 2008, and the most recent inspection was also completed in 2008, according to Richmond City’s own records. No reasonable person could consider what is present on this property to be “substantive progress” or “substantial work”. Even if the property owner was hand-forming bricks, hewing the lumber, and mining iron to forge nails himself, he should be farther along than this! If he has only managed to partially finish a foundation in five years, it should be clear at this point that the project will never be finished. This "project" has been allowed to skate by, or fly under the radar for far too long already. The time for action is now.

    In summary, nothing has been accomplished on this work project in over 5 years, aside from additions of trash, and additional inoperable vehicles to the lot. Please check your own records, mark this blighted property as abandoned, and revoke the building permit.

    There are numerous unresolved issues with this property that have been reported multiple times by myself and numerous other concerned neighbors. Unfortunatley, despite each and every complaint, nothing has been resolved. Most recently, the owner of this property has begun erecting a make-shift privacy fence in an attempt to hide the problem. He has left a pile of yard debris and other trash (carpet, refuse, aerosol cans, etc) in the street at the corner of the property. In addition to the new pile in the street; numerous piles of refuse are clearly visible from the street, scattered across the property. Please address this issue, along with the numerous other code violations present at this blighted property, that we have all complained about previously. Additionally, please review the history of this property, the numeous complaints filed against it, and the fact that nothing has been accomplished on this lot in the past five years!

    Citizen requests that this property be reported to the Mayor, and added to the list of properties on the Stop-Blight program. I have lived in this neighborhood near the property for 2+ years now, and have only seen the owner twice. First interaction with him, he was exceedingly rude, and made numerous verbal threats to myself and other neighbors. I have made NUMEROUS complaints to the city, with no resulting action from the owner. In the past week, the owner has dropped by to drop off fence sections. I can only assume that these few sections of fence, along with the post holes he recently dug at the street line will be used to erect a privacy fence in order to "hide" the problem. At this point, it should be CRYSTAL CLEAR as to the intentions of this property owner; not to remedy the problem and clean up his junk pile, but rather to do the absolute minimum in order to hide the problem. This is simply unacceptable, and should not be allowed to stand. There is no current building permit on the property, and it should be considered an illegal dumping ground. Since there is no active permit, all of the debris and trash on the ground can NOT be considered building materials, but junk. If you do consider them to be "building materials" then he must be cited for constructing without a permit.

    In summary... this has been a chronically problematic property for numerous years, and with many complaints. Numerous factors on the property need to be addressed immediately, and I hope that the mayor will add this to the list of blighted properties.
