Hello Carrie-Ann,

We sent an engineer out to investigate this situation this morning. The sump pump that you described is not truly an illicit discharge since the flows are not being directed into the street or into the stormwater system. It appears that the flows are primarily infiltrating into the ground but they may be directed toward your home in certain circumstances, which would be an issue to be investigated by the Code Enforcement Officer. I believe that this would be a civil matter. The noise of the sump pump is considered an "attractive nuisance" in that it is necessary to maintain the property, especially during this normal wet season. If it continues to be an issue you may wish to contact your landlord to intervene with the other property owner/manager.
